Web server logs: When you visit our web pages, we process the connection data of the requesting computer including the IP address, the web pages you visit on our site, the date and duration of the visit, the identification data of the browser and operating system type used as well as the web page from which you visit us by default to ensure the security of our IT systems.

We use cookies within the contact forms (also with the claim form DSGVO) in order to be able to assign the request internally by an identification number. If you wish to object to the further use of cookies, you can do so by deleting your browser history under Settings. A separate declaration to Sungas is not required. The next time you visit our website after deletion, you will be asked for your consent again.

Google Maps: For better illustration, we integrate a map provided by servers of Google Inc. on the subpages. When you display the map, a connection to the Google server is established, in which, among other things, the IP address is transmitted to Google. Google also has the option of writing and reading cookies. These cookies may be Google user cookies that are directly associated with your person. For more information about Google Maps, please refer to Google‘s Privacy Policy and Terms of Use at

Google Adwords: Our website uses Google AdWords Conversion Tracking. This is an analysis service of Google Inc., Amphitheater Parkway, Mountainview; California 94043, USA. The service places a cookie on your computer if you came to our site via a Google advertisement. We do not use the cookie to personally identify you. It is only used to determine whether a user has come to our website through an advertisement we have purchased. This makes it possible to track which advertisements you used to visit our website and whether you visited our website again afterwards. We use the findings from this analysis to be able to adapt our advertising more specifically. A complete overview of data processing can be found in Google‘s privacy policy. You can find this information at:

Google Analytics: This website uses Google Analytics, a web analytics service provided by Google, Inc. („Google“). Google Analytics uses „cookies“, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. However, if IP anonymisation is activated on this website, your IP address will be shortened by Google in advance within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA where it will be shortened. Google reCAPTCHA: On our website we also use the reCAPTCHA function of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA („Google“). This function is mainly used to differentiate whether an input, e.g. in the context of contact forms, is made by a natural person or whether it is misused by mechanical and automated processing. The service includes sending the IP address and any other data required by Google for the reCAPTCHA service to Google and is carried out in accordance with Art. 6 Para. 1 lit. f DSGVO on the basis of our legitimate interest in establishing the individual willingness to bear responsibility for actions on the Internet and the avoidance of misuse and spam. Google LLC, headquartered in the USA, is certified for the us-European data protection agreement „Privacy Shield“, which guarantees compliance with the data protection level applicable in the EU. Further information on Google reCAPTCHA as well as Google‘s privacy policy can be found at: If you have agreed to the use of cookies via the cookie banner, the data processing is based on the impermissible event of Article 6 para. 1 lit. a) DSGVO.

Do we pass on the collected data?

In cases where it is necessary for the operation of the website and the processing of your enquiry via the contact forms, we pass on your personal data to the extent necessary for this purpose. Insofar as these third parties are not independent persons in charge within the meaning of the DSGVO, this is referred to as order processing. In the case of order processing, Sungas, as the responsible party and client, commissions another agency to carry out certain data processing procedures which Sungas would otherwise carry out itself. According to Art. 4 No. 2 DSGVO, „processing“ must be interpreted widely and goes beyond the wording. This includes numerous actions in the handling of data, e.g. the collection, sorting or use of data.

However, the client, i.e. Sungas, retains full data protection responsibility for the handling of your personal data in the external relationship, i.e. in relation to you. In this case, Sungas therefore remains the addressee of all data subject rights (see below) and thus your contact person.

For example, we give the data to IT service providers who may have access to your data in the course of maintenance procedures for the software and hardware used by Sungas and through the provision of IT infrastructure.

In order to safeguard your rights, we conclude a contract processing agreement with all contract processors in accordance with Art. 28 DSGVO.

A transfer for processing outside the European Union does not take place.

On what legal basis is the collection and processing based?

If you are in a contractual relationship with Sungas and use the customer portal, we base the collection and processing on the legal basis of Article 6 para. 1 lit. b) DSGVO (processing for the fulfilment of a contract). If you do not have a contractual relationship with Sugas and send a request to Sungas via the contact form, the collection of the data is based on the impermissible event of Article 6 para. 1 lit. a) DSGVO, namely on your consent.

The data collected during your visit to our website without your consent (e.g. your IP address, the date and time of access, the pages accessed and the browser you use), we rely on the impermissible event of Article 6 para. 1 lit. f DSGVO, namely the processing to safeguard the legitimate interests of Sungas, here the interest to ensure the security of IT systems.

If you have consented to the use of cookies via the cookie banner, the data processing is based on the impermissible provision of Article 6 para. 1 lit. a) DSGVO.

How long do we store your data?

We store your data for as long as is necessary for the respective processing purpose (generally for a maximum period of 10 years). If the data are no longer necessary for the fulfilment of the processing purposes stated in this data protection declaration, they will be deleted, unless the storage is still necessary for the fulfilment of commercial or tax storage obligations or from the requirement of proof even after the exchange of services has taken place due to statutory warranty periods, as well as limitation periods. After expiration of the deletion obstacles, we delete your data unsolicited.

What rights do you have?

Your rights as a data subject result from Chapter III of the DSGVO. In particular, you have the following rights:

To the extent permitted by Art. 15 DSGVO, you may request information from the person responsible on the nature and scope of the personal data collected, processed and stored. Furthermore, you have a right to be informed of the information referred to in Art. 15 DSGVO, in particular about the existence of a right of appeal to a supervisory authority and the duration of the storage.

You may request the person responsible to correct the personal data concerning you that is incorrect or incomplete, Art. 16 DSGVO.

Under the conditions of Art. 17 DSGVO, you may request the deletion of your personal data by the person responsible.

Under the conditions set out in Art. 18 DSGVO, you may request the person responsible to restrict the processing of your personal data.

Under the conditions set out in Art. 20 DSGVO, you may request the person responsible to transfer your personal data to another person responsible.

Under the conditions of Art. 21 DSGVO, you may object to the processing of your personal data.

Where can I assert my claims?

The addressee of the claims is the person responsible. The companies of SUNGAS S.A R.L. maintain a form on the respective website under „Data Protection“ which you can use to make your claims.

The web address for the Sungas form can be found below:

Where can I exercise my right to appeal?

You can assert your right of appeal with the competent supervisory authority. The responsible supervisory authority is the data protection officer responsible in your federal state. For North Rhine-Westphalia, for example, you can find the contact information of the data protection officer Stand (12/2017) at

What would be the consequences if you did not provide the requested personal data?

You are of course free not to disclose the personal data you have requested. In this case, however, we would like to point out that, in accordance with the principle of data economy, the information requested is limited to that which is necessary to identify your person/contractual relationship or to answer your enquiry. Therefore, please understand that in the event that you do not provide the requested personal data, it is not possible for us to use the customer portal or answer your enquiry.
