Information on the collection and processing of personal data on the websites of ENERGUS
ENERGUS would like to inform you in the following data protection declaration to what extent data is collected in connection with visiting our websites and using the contact forms and for what purpose this data is used.
Furthermore, ENERGUS would like to show you the rights to which you are entitled in this context.

Personal data is any information relating to an identified or identifiable natural person. For example, data that is generated during the use of our websites through cookies and unique identifiers such as IP addresses.
When you register in our customer portal, we record your postal code and your customer number for the purpose of identification and assignment to an existing contractual relationship.
If you use the customer contact form or the claim form for the DSGVO, we record the looking up personal data for the purpose of identification:
We use the data for the identification of your person and your existing contractual relationship, as the case may be, as well as for checking the asserted claim within the scope of using the customer portal or the contact/DSGVO claim form.
Contact form: You can contact us via our contact form. We process your data in order to answer your enquiry and, if necessary, to send you requested information material.
Web server logs: When you visit our web pages, we process the connection data of the requesting computer including the IP address, the web pages you visit on our site, the date and duration of the visit, the identification data of the browser and operating system type used as well as the web page from which you visit us by default to ensure the security of our IT systems.
In cases where it is necessary for the operation of the website and the processing of your enquiry via the contact forms, we pass on your personal data to the extent necessary for this purpose. Insofar as these third parties are not independent persons in charge within the meaning of the DSGVO, this is referred to as order processing. In the case of order processing, Sungas, as the responsible party and client, commissions another agency to carry out certain data processing procedures which Sungas would otherwise carry out itself. According to Art. 4 No. 2 DSGVO, „processing“ must be interpreted widely and goes beyond the wording. This includes numerous actions in the handling of data, e.g. the collection, sorting or use of data.
However, the client, i.e. Sungas, retains full data protection responsibility for the handling of your personal data in the external relationship, i.e. in relation to you. In this case, Sungas therefore remains the addressee of all data subject rights (see below) and thus your contact person.
For example, we give the data to IT service providers who may have access to your data in the course of maintenance procedures for the software and hardware used by Sungas and through the provision of IT infrastructure.
In order to safeguard your rights, we conclude a contract processing agreement with all contract processors in accordance with Art. 28 DSGVO.
A transfer for processing outside the European Union does not take place.
If you are in a contractual relationship with Sungas and use the customer portal, we base the collection and processing on the legal basis of Article 6 para. 1 lit. b) DSGVO (processing for the fulfilment of a contract). If you do not have a contractual relationship with Sugas and send a request to Sungas via the contact form, the collection of the data is based on the impermissible event of Article 6 para. 1 lit. a) DSGVO, namely on your consent.
The data collected during your visit to our website without your consent (e.g. your IP address, the date and time of access, the pages accessed and the browser you use), we rely on the impermissible event of Article 6 para. 1 lit. f DSGVO, namely the processing to safeguard the legitimate interests of Sungas, here the interest to ensure the security of IT systems.
We store your data for as long as is necessary for the respective processing purpose (generally for a maximum period of 10 years). If the data are no longer necessary for the fulfilment of the processing purposes stated in this data protection declaration, they will be deleted, unless the storage is still necessary for the fulfilment of commercial or tax storage obligations or from the requirement of proof even after the exchange of services has taken place due to statutory warranty periods, as well as limitation periods. After expiration of the deletion obstacles, we delete your data unsolicited.
Your rights as a data subject result from Chapter III of the DSGVO. In particular, you have the following rights:
To the extent permitted by Art. 15 DSGVO, you may request information from the person responsible on the nature and scope of the personal data collected, processed and stored. Furthermore, you have a right to be informed of the information referred to in Art. 15 DSGVO, in particular about the existence of a right of appeal to a supervisory authority and the duration of the storage.
You may request the person responsible to correct the personal data concerning you that is incorrect or incomplete, Art. 16 DSGVO.
Under the conditions of Art. 17 DSGVO, you may request the deletion of your personal data by the person responsible.
Under the conditions set out in Art. 18 DSGVO, you may request the person responsible to restrict the processing of your personal data.
Under the conditions set out in Art. 20 DSGVO, you may request the person responsible to transfer your personal data to another person responsible.
Under the conditions of Art. 21 DSGVO, you may object to the processing of your personal data.
Where can I assert my claims?
The addressee of the claims is the person responsible. The companies of SUNGAS S.A R.L. maintain a form on the respective website under „Data Protection“ which you can use to make your claims.

You can assert your right of appeal with the competent supervisory authority. The responsible supervisory authority is the data protection officer responsible in your federal state. For North Rhine-Westphalia, for example, you can find the contact information of the data protection officer Stand (12/2017) at http://www.ldi.nrw.de.
You are of course free not to disclose the personal data you have requested. In this case, however, we would like to point out that, in accordance with the principle of data economy, the information requested is limited to that which is necessary to identify your person/contractual relationship or to answer your enquiry. Therefore, please understand that in the event that you do not provide the requested personal data, it is not possible for us to use the customer portal or answer your enquiry.
